Terms of use.

Draft 1 · prepared

These terms apply when you use this website. By using it you agree to them. If you do not agree, please do not use the site. They are about the website; a confirmed order is governed by our written quotation and your purchase order, together with the Refund and cancellation policy.

Who we are

This website is run by TODO (owner) legal name of the business (TODO (owner) business constitution), trading as Southwest Exports, based in Nashik, Maharashtra, India. Registered address: TODO (owner) registered address. Contact: southwestexports@gmail.com, +91 9511855778. Southwest Exports’s registration is in progress; we will publish registration numbers on the About page once they are issued.

Using the website

  • You may browse the site and send us an enquiry for lawful business purposes.
  • You must not misuse the site: do not try to break into it, overload it, scrape it in bulk, send malicious content, or pretend to be someone else.
  • Give true details when you send an enquiry.
  • We may change, pause or remove any part of the site at any time, without notice.

The site makes no offer of sale

This website is a catalogue and a way to ask us for a quotation. It is not a shop. Nothing on it is an offer to sell. Prices, specifications, minimum order quantities, lead times and availability are not fixed on the site: we confirm them for each enquiry.

A binding order is made only in these steps:

  1. You send an enquiry.
  2. We send you a written quotation with the specification, price, lead time and terms.
  3. You send a purchase order (or accept the quotation in writing) and pay the advance the quotation asks for.
  4. We confirm the order in writing. From then it is binding on the terms in the quotation.

Until step 4, either of us may decide not to go ahead. Our usual commercial terms (for example the advance and the balance against the Bill of Lading) are summarised in the buyer guide; the terms in your quotation apply.

Information on the site is indicative

Product descriptions, “commonly used for” notes, photos, drawings, container sizes and volumes, and the route map are there to help you understand what we supply. They are indicative only. Photos and drawings may differ from the goods you receive. The route map shows where we can ship, not where we have shipped. Check the specification in your quotation, and check that a product suits your use and the rules of your destination country, before you order.

Content and ownership

The text, design, logo, drawings and layout of this site belong to Southwest Exports or are used with permission. The hero video is credited to its creator in the footer and is used under the Pexels licence. You may view the site and print pages for your own business use. You may not copy, republish or sell our content, or use our name or logo, without our written permission. All rights not expressly given are reserved.

The site links to services such as WhatsApp and OpenStreetMap. We do not control them and are not responsible for their content or how they use your data.

Disclaimers

We try to keep the site accurate, but we give it to you “as is”. We do not promise that it is free of errors, always available, or complete. Nothing on it is professional, legal, tax or customs advice.

Limit on our liability

To the extent the law allows, we are not liable for any indirect or consequential loss, or loss of profit, business or data, that comes from using or not being able to use this website or relying on information on it. Nothing in these terms limits liability that the law does not allow to be limited, such as for fraud. Liability for goods under a confirmed order is set by the quotation, the purchase order and the Refund and cancellation policy, not by this section.

Governing law and courts

These terms are governed by TODO (owner) governing law, e.g. the laws of India (lawyer to confirm). The courts of TODO (owner) jurisdiction, e.g. the courts at Nashik (lawyer to confirm) have jurisdiction over any dispute about them, unless the law gives you the right to go elsewhere.

Your personal data

How we handle personal data is explained in the Privacy policy. Browser storage is explained on the Cookies page.

Changes to these terms

We publish any change on this page, with a new version and date at the top. The terms that apply to you are the ones shown on this page when you use the site. A change does not alter an order we have already confirmed in writing.
